You may want your land to remain forever free from any future development. Or, you may want to plan for limited uses that preserve the special character of your land.

Either way, you have the right to determine today what happens to your land in the future.  It is a great power, and a choice you can make to permanently protect your land from unwanted future development. Or, plan for uses that preserve the special character of your family's land.

Land protection options to legally preserve your land are made available by LCHC. These include the Conservation Easement, which can also bring important tax benefits, such as an income tax deduction and reduced property and estate taxes.  If you decide to take action now, you can rest assured that your desires to preserve your land are legally established.

What is a Conservation Easement? A Conservation Easement (CE) provides a time-honored and legal way for families to preserve their lands. It assures landowners that their wishes for preservation of their property will be honored forever.

bulletThe CE is a legal document -- an agreement between the landowner and the land trust that accepts it. It is a deed restriction that permanently limits a property's future uses.
bulletEach CE document is individually drafted to meet the personal needs of the landowner.
bulletThe CE is donated to a qualified land trust, which in turn agrees to monitor the land to assure that the conditions of the easement are met over time.
bulletThe CE is recorded in the County Recorders office, and becomes part of the property's title.
bulletFuture owners of the property are bound by the CE's terms.

Landowners continue to own their home and land -- and live there. They can also mortgage the property, lease it or sell it -- or pass it on to their heirs.
